Description

This paper argues that the global governance of human protection constitute a transnational legal order (TLO), moving deeper into the realm of regulatory governance and issue specific ordering of transnational behaviours. The paper considers the implications of conceptualising the human protection TLO, including new insights on the regulatory function of international norms, the associated rise in demand for implementation and accountability mechanisms, and the fragmentation of international law. To this end it challenges the narrative of progress associated with the consolidation of the human protection TLO and accounts for the politics that mediates the regulatory capacity of the TLO.
