AISYL Project: Exploring the Impact of Artificial Intelligence on Rights and Decision-Making in Asylum Systems

The increasing use of Artificial Intelligence (AI) in asylum procedures is reshaping decision-making processes in Europe, including Austria. While AI promises to streamline procedures, reduce errors, and lower costs, its application in asylum systems raises significant ethical and legal concerns. Our research project critically examines both the opportunities and risks associated with the implementation of AI technologies in asylum procedures in Austria. We focus on potential violations of fundamental rights, such as the right to an effective remedy, privacy, and non-discrimination, which are particularly vulnerable to automation bias and algorithmic errors.

The project aims to produce a practical guide for civil society organizations that assist asylum seekers in navigating these increasingly digitalized systems. It will provide tools to help advocates understand and challenge the implications of AI in asylum cases. By collaborating with legal and technical experts, as well as stakeholders in civil society, we ensure that the guide is both accurate and practical.

Preliminary results, based on expert interviews and legal analyses, will be presented. These results will highlight the current use of AI in Austria’s asylum system, anticipated future trends, and the legal frameworks governing these developments. Our findings will contribute to a broader understanding of how AI impacts the rights and experiences of asylum seekers, while also offering concrete recommendations for advocacy and policy reform.
